Canada accepts Apostilled Thai affidavits across IRCC (Immigration, Refugees and Citizenship Canada), provincial superior courts, and the CRA. Canada deposited its Hague Apostille accession on 11 May 2023, with entry into force on 11 January 2024; combined with Thailand's accession on 7 January 2025, Apostille is the bilateral mechanism. Legal basis in Canada
Federal acceptance follows the Canada Evidence Act and IRCC procedural guidelines. Provincial acceptance follows each province's Evidence Act (e.g. Ontario Evidence Act, British Columbia Evidence Act). The Apostille is recognised under the 1961 Hague Convention which Canada implemented through the Federal Authentication and Apostille Programs effective 11 January 2024.
Receiving authorities and acceptance rules
(1) IRCC accepts Apostilled Thai affidavits for spousal sponsorships, statutory declarations of common-law union, and replacement of lost documents. (2) Provincial superior courts accept Apostilled affidavits under their respective Evidence Acts. (3) The CRA accepts them for tax-residency declarations. (4) Translations into English or French must be produced by a certified translator (ATIO in Ontario, OTTIAQ in Quebec, STIBC in BC, etc.).
